YOUR CONDITIONS OF HIRE WITH LOCH LOMOND LODGE
I. Terms. All terms are per week [Saturday to Saturday) unless as otherwise stated, for the lodge. The usual time of takeover is 4 pm (subject to unavoidable delays).
You must leave your lodge by 10 am (later departures may be charged extra).
You are obliged to leave everything in a clean and tidy condition and leave the beds and duvets stripped of the linen. You are responsible for any damage done or loss sustained during your stay.
We also reserve the right to correct errors in advertised prices. In this case , we will contact you as soon as we become aware of the error. If the correct price is higher and you do not wish to pay this, you will be entitled to cancel and receive a full refund of all monies you have paid to us providing you notify us within 14 days of our advising you of the error. We promise we will not seek to correct any error in a confirmed price within 8 weeks of the start of your holiday or more than 7 days after you make your booking.
For holidays of 7 days or more starting Sunday, Monday or Tuesday, the previous Saturday charges apply; for Wednesday, Thursday or Friday starts the following Saturday charges apply. for 3 or 4 night Breaks that cover two price periods, the week in which the greater number of nights are taken applies. Where an equal number of nights are taken in two different price periods, the average of the weekly prices applies.
2. Booking confirmation. A binding contract between you and the owner will come into existence when we issue a hire invoice and booking acceptance. The contract shall be deemed to have been made at no 14 Ballencrieff Mill, Balmuir Road, Bathgate, West Lothian, EH48 4LL. and be subject to Scottish Law. We both agree to submit any dispute to the exclusive jurisdiction of the Courts of Scotland. In all cases these Conditions of Hire form the basis of your contract.
3 Damage and Good Housekeeping deposit. A `Security/Damage` deposit of £100 is also required which should be sent along with the booking balance and as a separate cheque. This will be destroyed after the lodge has been vacated, cleaned and the inventory checked. Please note that if there is extra cleaning required as a result of occupation (including the BBQ) or from that caused by any pet, or due to smoking in the lodge, a retention of an appropriate amount (at the sole decision of the owner) will be made to cover extra cleaning costs and time. If the new occupants are inconvenienced in any way, we will reserve the right to withhold the full deposit as compensation to such new occupant.
Access to the estate is via remote controlled gate. In the event of loss of the remote control (including taking it home), £100 will be deducted from the deposit to facilitate its replacement and/or arrangements for the incoming occupiers.
For New Year bookings the deposit is £150 and is banked. This will be returned by cheque after your stay.
4. Number of people staying. The property can accommodate up to eight people and it is incumbent on you that this is not exceeded. Babies under two occupying a cot are in addition. You also agree not to exceed the number of people on the booking form. Where any discount has been offered for under occupancy, there will be an increase in the rate if you add more to the original enquiry or booking.
5. Number in your party. It is a condition of your booking that the total number in your party shall not exceed the capacity of the lodge as advertised and all persons sleeping in the lodge must be named on the booking form. Babies under 2 may or may not be counted as members of your party. You also agree not to exceed the number of people on the booking form.
6. Booking monies. When you book you must pay the applicable Booking Deposit as part-

through your travel agent. Please tell us if you have already paid your balance-

All or part of your liabilities as stated above may be covered if you have purchased a Cancellation Insurance and your reason for cancellation is one of those covered.
9. Minors. We cannot accept bookings from anyone under 21 years of age.
10. Availability. Your booking is accepted on the understanding that your confirmed Lodge will be available for your use on the agreed date. Very occasionally," force majeure" does not make it possible. Where "force majeure" ( as defined in clause 9 ) arises, we have the right to cancel your booking. In this event , we will endeavour to offer you an alternative Lodge, if available. If we cannot do so or if you do not wish to accept the alternative we offer, we will refund all monies you have paid to us in full. Where any cancellation or change results from " force majeure" as defined in clause 9, our liabilities are limited to offering you an alternative property ( where available) or full refund as set out above. We regret we cannot pay any compensation or meet any expenses or costs you may incur as a result of any such cancellation or change.
We have the right to refuse to hand over accommodation to any person(s) who, in our reasonable opinion, is not suitable to take charge of it. In such cases, all hire charges paid will be refunded in full, the contract shall be terminated and we will not have any further liability.
If in our reasonable opinion, any person(s) is not suitable to continue the holiday because of unreasonable behaviour, damage to property or danger or significant annoyance to others, the Contract may be terminated, in which case we will not have any further liability. In this event, you will remain liable to pay the hire price and no refund shall be due. The hirer shall also be liable for any damage caused in the lodge. We have the right to enter any accommodation (without prior notice if this is not practical or possible) if special circumstances or emergencies arise (for example, if repairs need to be carried out).
11. Force Majeure. We cannot accept responsibility or pay any compensation where the performance or prompt performance of our contract with you is prevented or affected by reason of circumstances which amount to "force majeure".
Circumstances amounting to"foroce majeure" include any event which we could not,
even with all due care, forsee or avoid. Such circumstances include the destruction
or damage of your Lodge ( which cannot reasonably be remedied to a satisfactory standard
before the start of your holiday ) through fire, flood, explosion, storm or other
weather damage, break-
l2. Your Pet. Pets are permitted by prior arrangement by owner, at a charge of £25.
YOU MUST BRING YOUR PET BASKET,TOWELS AND DISHES WITH YOU as pets are allowed on the clear understanding that in no circumstances may they lie on bedding or chairs. Pets must not be left unattended in Lodges or elsewhere.
Animals other than dogs can only be accepted with specific permission from the owners.
In the interest of visitors safety and following government legislation, we are sorry we are unable to accept the following types of dog: American Pit Bull terrier, Japanese Tosa, Fila Brasileiro and Dogo Argentino even where these types of dog are muzzled as required by government legislation.
13. Your Vehicle. Your vehicles and their accessories and contents are left entirely at your own risk. We will not be responsible for any loss or damage from or to any vehicle from any cause whatsoever.
14. Liability, except where otherwise specified in these Conditions of Hire, we cannot accept liability for any damage, expense, injury, death or loss of any nature whatsoever suffered by any person(s) from any cause whatsoever other than the proven negligence of ourselves.
15. Any shortcomings. You must notify any shortcomings with your Lodge immediately so that remedial action, if appropriate, can be taken.
For all complaints and claims which do not involve personal injury, illness or death, we regret that we cannot accept any liability if you fail to notify the owner of any complaint or claim during your holiday and write to us with full details within 28 days of the end of your holiday.
